Implications for Short Term Letting
This important case the Victorian Building Appeals Board (BAB) decided to disallow short-term use of residential apartments, in what appeared a landmark case with implications Australia-wide.
It was found that short term letting of apartments contravened the Occupancy Permit. With the growth of Air B&B and Stayz.com this is becoming an issue for Owners Corporations.
Important lessons:
- Know your Occupany Permit.
- Review your rules.
On appeal to the Vic Supreme Court, that decision was overturned. However this short-term apartment battle goes on, with the City of Melbourne appealing the Supreme Court Watergate decision.
